Privacy Policy

NetDealer DMS ("NetDealer") is a product and service offered by TEKS Solutions LLC ("TEKS," "we," "us," or "our").

This Privacy Policy describes how TEKS collects, uses, discloses, and protects information in connection with the NetDealer website, NetDealer subscriptions, and related services.

This policy does not replace the privacy obligations of dealerships that use NetDealer to manage information about their own customers.

1. Information We Collect

A. Website and Contact Information

When you visit the NetDealer website, contact us, request a demonstration, join a waitlist, request access, or begin a subscription, we may collect information such as:

  • name;
  • dealership or business name;
  • email address;
  • telephone number;
  • state or location information;
  • dealer type;
  • approximate inventory size;
  • current dealer-management system;
  • messages or inquiries submitted to us; and
  • marketing attribution information.

B. Subscription and Account Information

When a dealership subscribes to or uses NetDealer, we may collect:

  • dealership information;
  • account administrator information;
  • authorized-user information;
  • subscription and plan information;
  • billing status;
  • transaction identifiers;
  • account configuration information;
  • support communications; and
  • information necessary to administer the subscription.

C. Payment Information

Payments for NetDealer subscriptions may be processed through Authorize.Net or another payment processor.

Payment-card information entered through a hosted or tokenized payment experience is transmitted to and processed by the applicable payment processor.

TEKS may receive and store information associated with the transaction, such as payment status, customer identifiers, subscription identifiers, transaction identifiers, payment tokens where applicable, and limited payment-method information provided by the processor.

TEKS does not intentionally store full payment-card numbers or card security codes submitted through a hosted payment processor.

D. Dealership Customer Data

Dealerships using NetDealer may enter or process information concerning their customers, vehicles, deals, accounts, payments, documents, and other dealership operations.

The dealership controls the business purpose for which that information is collected and used.

TEKS processes such information as necessary to provide NetDealer to the dealership and subject to applicable agreements and law.

Dealerships are responsible for providing their own customers with any privacy notices and obtaining any permissions or consents required by law.

E. Device, Usage, and Technical Information

When the website or Service is used, we may automatically receive information such as:

  • IP address;
  • browser type;
  • device type;
  • operating system;
  • pages viewed;
  • referring page;
  • approximate location derived from IP address;
  • timestamps;
  • application events;
  • diagnostic information; and
  • security and performance information.

2. How We Use Information

We may use information to:

  • provide and operate NetDealer;
  • create and administer subscriptions;
  • communicate with prospective and existing customers;
  • respond to contact and demo requests;
  • process and verify subscription payments;
  • provide customer support;
  • maintain and improve the Service;
  • diagnose technical issues;
  • protect the security and integrity of NetDealer;
  • prevent fraud or misuse;
  • understand website and product usage;
  • measure marketing performance;
  • comply with legal obligations; and
  • enforce our agreements.

3. Analytics and Website Technologies

The NetDealer website may use analytics and performance technologies such as Google Analytics, Google Tag Manager, Microsoft Clarity, or similar services.

These technologies may collect information about website interactions, device information, referral sources, pages visited, and usage patterns.

TEKS configures its analytics implementation not to intentionally send form fields such as names, email addresses, telephone numbers, or dealership contact information to analytics platforms.

Where required by applicable law, consent mechanisms may be used for cookies or similar technologies.

4. Marketing Attribution

When you reach NetDealer through a search engine, advertisement, referral, or marketing campaign, we may collect attribution information such as:

  • UTM source;
  • UTM medium;
  • UTM campaign;
  • UTM content;
  • UTM term;
  • referring page;
  • landing page; and
  • advertising identifiers such as a Google click identifier when present.

We use this information to understand and improve our marketing efforts.

5. How We Disclose Information

TEKS does not sell personal information for money.

We may disclose information to service providers that help us operate NetDealer, including providers of:

  • cloud and website hosting;
  • payment processing;
  • email and communications;
  • analytics;
  • security;
  • technical infrastructure; and
  • professional services.

These providers receive information as reasonably necessary to perform services for TEKS.

We may also disclose information:

  • when required by law, subpoena, court order, or legal process;
  • to protect TEKS, NetDealer, customers, users, or others;
  • to investigate fraud, security incidents, or misuse;
  • in connection with a merger, acquisition, financing, restructuring, or sale of all or part of a business, subject to applicable law; or
  • with consent or at the direction of the applicable customer.

6. Payment Processors

Subscription payments may be processed by Authorize.Net.

Payment processors maintain their own privacy and security practices and may collect information directly from you when processing payments.

TEKS receives only the payment and transaction information necessary to administer the NetDealer subscription and related business records.

7. Data Security

TEKS uses administrative, technical, and organizational safeguards designed to protect information against unauthorized access, loss, misuse, alteration, or disclosure.

No electronic system or method of transmission can be guaranteed to be completely secure.

Customers are responsible for protecting their NetDealer credentials and for appropriately managing access granted to their personnel.

8. Data Retention

We retain information for as long as reasonably necessary to:

  • provide NetDealer;
  • maintain business and accounting records;
  • fulfill contractual obligations;
  • provide support;
  • protect security;
  • resolve disputes;
  • enforce agreements; and
  • comply with legal requirements.

Retention periods may vary depending on the type of information and the reason it is maintained.

Information may also remain temporarily in backups and disaster-recovery systems.

9. Customer Data After Termination

When a dealership's NetDealer subscription ends, access to dealership data may be restricted or terminated.

Dealerships should obtain any information they are required to retain before termination where export or retrieval functionality is available.

TEKS may retain information for a reasonable period following termination for legal, security, backup, accounting, dispute-resolution, or regulatory purposes and may thereafter delete or anonymize information in accordance with applicable requirements and retention practices.

10. Privacy Rights

Depending on where you reside and applicable law, you may have rights concerning personal information, which may include rights to request access, correction, deletion, or information regarding certain uses or disclosures.

These rights may be subject to legal exceptions.

Requests concerning information controlled directly by a dealership should generally be directed to that dealership.

Requests concerning information controlled by TEKS may be submitted using the contact information below.

TEKS may need to verify a request before responding.

11. Children

NetDealer is a business service and is not directed to children.

We do not knowingly use the NetDealer website to solicit personal information from children.

12. Third-Party Links and Services

NetDealer may contain links to or integrate with third-party websites, applications, or services.

TEKS is not responsible for the privacy practices of independent third parties. Their privacy policies and terms govern their services.

13. International Processing

Information may be processed or stored in locations where TEKS or its service providers operate.

Where required, TEKS will handle cross-border transfers in accordance with applicable legal requirements.

14. Changes to This Privacy Policy

We may update this Privacy Policy from time to time.

The updated policy will identify the effective or last-updated date.

For material changes, we may provide additional notice where appropriate or required by law.
